NIE number, residence certificate and Padrón certificate

What is the NIE number? The NIE or Foreign identification number is an identification for the foreigners who has a relation with Spain for economic, professional or social interests shall be provided with a personal, unique and exclusive sequential number, for identification purposes. Your NIE will be also your fiscal number for all the procedures before the Inland Revenue.  The NIE number is issued by the foreign office at the Police Station or through Spain’s Consular Posts abroad. Applications must be submitted at the Consular Post of the district in which the foreigner resides, either personally or through a duly accredited representative by signing a power of attorney , and the application must be accompanied by a copy of the biographical page of the passport containing the holder’s information (EU citizens can provide a copy of their identity card), and by proof of the economic, professional or social interests justifying the application. The public fee to obtain the NIE number is 9,64 euros.

It´s compulsory an NIE number for buying a property in Spain?  Despite the NIE number is not compulsory for buying a property in Spain, it is for registration of the property at the Land Registry.

RESIDENCE CERTIFICATE FOR EUROPEAN UNION CITIZENS.

First, let me clarify, these two concepts;

  • Fiscal Residence:  It is considered fiscal resident, ONLY for fiscal purposes, the person who spends more than 183 days in Spanish Territory. The fiscal residence means that all the taxes will be paid in Spain, taking into account the bilateral agreements between States.  
  • Administrative residence:  The administrative residence, is a residence certificate issued the foreign office that proofs that you are considered resident, also for fiscal purposes, in Spain. The fiscal residence doesn’t involve the administrative residence whereas the administrative residence involves the fiscal residence.

Now, we are going to focus in the administrative residence. If a European citizen wants to obtain his residence in Spain, he will need to apply for the Residence Certificate, as well known, the inscription at the European citizens register certificate. It is also mandatory to ask for this certificate the citizens of the European Union or of the European Economic Area or Switzerland that wants to reside in Spanish Territory for a longer term of three months. The residence certificate proves your condition as a resident in Spain. For its application, you must comply one of these conditions:

  • Being a self-employed in Spain
    • Registration in the Economical activity’s census.
    • Registration in the business register.
    • Documentation as you are registry in the social security institution.
  • Being an employee in Spain.
    • Employ certificate issued by the company (name& address of the company, social security number fiscal identification).
    • Contract.
    • Document that declare that you are registry in the Social Security Institution.
  • To prove that you have enough economic resources for you and your family
    • (P60 or a document that stablished your rent), 6 last months of bank statement.
    • health insurance or S1.
  • If you are student enrolled in a public or private school or institution. You will need a health insurance
    • Inscription of the school or educational centre.  
    • Health insurance.
    • Declaration of economical resource for your stance in the country during that period.
  • A national of European country which is a relative of a European citizen based in Spain (descendants, ascendants, spouse or unmarried partner inscribed).
    • Documentation for proving the link with the relative. Must be updated.
    • Documentation that proves the economic dependency
    • Documentation that proves that the relative commit one of the conditions above and it has enough economical resources.

Procedure application:

You can apply for the residence certificate after the three months from the arrival in Spain, before the Foreign office at the Police Station. The applicant must present personally to any of the Foreign Offices, is not possible to do this procedure via representation. The public fee to obtain the resident certificate is 12 euros approximate.

PADRÓN CERTIFICATE.

What is the Padrón certificate? Is a document issued by the Town Hall that serves for the registration of the residence in a municipal area. The Padrón in Spain has two main purposes:

  • Census: Authorities calculate how many public services (health, police, administration, etc.) each area needs.
  • Local, regional, national or European elections.

It is important to clarify that the Padron is not an identification document, and it doesn´t involve the Spanish Residency. Nevertheless, if you are non-fiscal resident in Spain, you shouldn´t apply for this certificate, as it can be considered as a proof in favour of the Inland Revenue in order to prove you are a fiscal resident.

Another common wrongly believe is that for buying a car you need the Padron certificate, and usually car dealers ask you for it.  But is not, a foreigner has the right to buy a car without being registered in the Padron, because as said before, the registration at the Padron, can constitute an evidence in favour of the Inland Revenue for paying your taxes in Spain.

The documents required for the Padron can differ depending on the Town Hall, but normally they ask you for:  

  • NIE original document and/ or Passport document.
  • In case of a rental property, Passport /NIE/ DNI (identification number) of the owner, rental contract and IBI (Council Tax receipt). The documentation of the owner is compulsory.
  • Purchase property title deed or rental contract.
  • It might ask you for the electricity and water bills.
